Terms of Service

These terms apply when ALMAVIS builds or maintains a website for you, or manages your Google Ads advertising. By accepting a quotation, paying an invoice, or granting us access to your advertising account, you agree to them.

1. Who we are

ALMAVIS, Mbezi Beach, Dar es Salaam, Tanzania. WhatsApp and phone +255 668 544 942. Working hours Monday–Friday 08:00–18:00, Saturday 09:00–13:00 (EAT).

2. Websites

We build the website from materials you provide, or from photographs and information your business has already published publicly.
A sample website shown before you order is a demonstration. It stays online for 21 days and is then removed unless you order the service.
Hosting, a domain and maintenance are included for as long as the subscription is paid.
Materials you supply remain yours. You confirm you have the right to use them. We are not responsible for claims arising from material you supply.
If the subscription ends, the website goes offline. On request we will give you the content and images in a usable form at no charge.

3. Google Ads management

Your account, your money. The Google Ads account belongs to you. You pay Google directly, with your own payment method. ALMAVIS never holds your advertising budget and never asks for the password to your account. We work through an invitation to a manager account, which you accept and which you can withdraw at any time from your own account, without telling us first.

Budgets — please read this part carefully

Google may spend up to twice your daily budget on any single day. This is how Google works and it is outside our control. Google treats the daily budget as an average: it may spend more on a busy day and less on a quiet one. What Google guarantees is the monthly amount — your daily budget multiplied by 30.4. We set your daily budget so that the monthly figure matches what we agreed with you.

In addition, our own systems track your spending from the first day of each month and pause your campaigns when the agreed monthly limit is reached. This is a second layer of protection, not a guarantee: it depends on data that Google provides with a delay, so a limited overrun is possible. Any limit you set, and every change to it, is recorded with the date.

We do not change your budget, add keywords, or change your ads without telling you. Changes that affect what you spend are prepared as proposals and applied only after you approve them.
You can ask us to stop all advertising at any time. We will do it the same working day.
Where you give us conversion tracking details, we install them on the website we built for you so that your advertising can be measured.

What we do not promise

We do not promise a number of enquiries, sales, or a position in search results. Nobody can, and anyone who does is guessing.
Advertising costs vary with competition, season and what your competitors do. We will tell you honestly when a budget is too small for a goal.
Google may reject an advertisement or suspend an account under its own policies. We will tell you and work to resolve it, but the decision is Google's.

4. Payment

Website subscriptions are paid monthly in advance.
Advertising management fees are separate from what you pay Google for the advertising itself.
If payment is more than 14 days late we may suspend the service after telling you. We do not delete anything for 30 days after that.

5. Ending the agreement

You may end it at any time, effective at the end of the paid month. There is no penalty and no minimum term.
We may end it with 30 days' notice.
We may end it immediately if the service is used for anything unlawful, for fraud, or for content that breaks Google's policies.
When it ends, you keep your Google Ads account, your campaign history and your data. We remove our access.

6. Responsibility

We do our work carefully and correct our own mistakes at no charge. Where we are responsible for a loss, our total liability is limited to the fees you paid us in the three months before the problem arose.

We are not responsible for what Google, Cloudflare, Meta or your internet provider do or fail to do, for money you spend on advertising through your own account, or for losses caused by information you gave us that turned out to be incorrect.

Nothing in these terms limits any right you have under Tanzanian law that cannot be limited by agreement.

7. Privacy

How we handle personal data is described in our Privacy Policy, which forms part of these terms.

8. Changes and disputes

If we change these terms we update the date above and tell current clients directly. Changes take effect for you at the start of your next paid month.

These terms are governed by the laws of Tanzania. If there is a disagreement, talk to us first — most problems are solved in one conversation. If that does not work, the courts of Dar es Salaam have jurisdiction.

Masharti haya yanatumika pale ALMAVIS inapokutengenezea au kukutunzia tovuti, au kusimamia matangazo yako ya Google Ads. Ukikubali bei, ukilipa, au ukitupa ruhusa ya kuingia kwenye akaunti yako ya matangazo, unakubali masharti haya.

1. Sisi ni nani

ALMAVIS, Mbezi Beach, Dar es Salaam, Tanzania. WhatsApp na simu +255 668 544 942. Saa za kazi: Jumatatu–Ijumaa 08:00–18:00, Jumamosi 09:00–13:00.

2. Tovuti

Tunatengeneza tovuti kwa vitu unavyotupa, au kwa picha na taarifa ambazo biashara yako tayari imeziweka hadharani.
Tovuti ya mfano inayoonyeshwa kabla ya kuagiza ni onyesho tu. Inakaa mtandaoni siku 21 kisha inaondolewa kama hutaagiza huduma.
Hosting, domain na matunzo vimejumuishwa muda wote ambao malipo ya mwezi yanaendelea.
Vitu unavyotupa vinabaki vyako. Unathibitisha una haki ya kuvitumia.
Huduma ikiisha, tovuti inaondoka mtandaoni. Ukiomba, tutakupa maandishi na picha zako bila malipo.

3. Usimamizi wa Google Ads

Akaunti ni yako, fedha ni zako. Akaunti ya Google Ads ni yako. Unalipa Google moja kwa moja. ALMAVIS haishiki fedha zako za matangazo na haiombi nywila ya akaunti yako. Tunafanya kazi kwa mwaliko kwenda akaunti ya msimamizi, ambao unaukubali na unaweza kuuondoa wakati wowote mwenyewe, bila kutuambia.

Bajeti — soma sehemu hii kwa makini

Google inaweza kutumia hadi mara mbili ya bajeti yako ya siku katika siku moja. Hivi ndivyo Google inavyofanya kazi na hatuwezi kuizuia. Google inachukulia bajeti ya siku kama wastani: inaweza kutumia zaidi siku yenye watu wengi na kidogo siku tulivu. Kinachohakikishwa ni kiasi cha mwezi — bajeti ya siku mara 30.4. Tunaweka bajeti yako ya siku ili kiasi cha mwezi kiwe sawa na tulichokubaliana.

Zaidi ya hapo, mfumo wetu unahesabu matumizi yako kuanzia siku ya kwanza ya mwezi na unasimamisha kampeni kikomo cha mwezi kinapofikiwa. Hii ni safu ya pili ya ulinzi, si dhamana: inategemea taarifa ambazo Google hutoa kwa kuchelewa, hivyo kuzidi kidogo kunawezekana. Kila kikomo unachoweka, na kila mabadiliko yake, kinarekodiwa na tarehe.

Hatubadilishi bajeti yako, hatuongezi maneno muhimu wala hatubadilishi matangazo bila kukuambia. Mabadiliko yanayogusa matumizi yanaandaliwa kama mapendekezo na yanatekelezwa baada ya wewe kukubali.
Unaweza kutuomba tusimamishe matangazo yote wakati wowote. Tunafanya hivyo siku hiyo hiyo ya kazi.

Tusichoahidi

Hatuahidi idadi ya wateja, mauzo, wala nafasi kwenye matokeo ya utafutaji. Hakuna anayeweza kuahidi hivyo.
Gharama za matangazo hubadilika kulingana na ushindani na msimu. Tutakwambia ukweli bajeti ikiwa ndogo kuliko lengo.
Google inaweza kukataa tangazo au kusimamisha akaunti kwa sera zake. Tutakujulisha na kushughulikia, lakini uamuzi ni wa Google.

4. Malipo

Huduma ya tovuti hulipwa kila mwezi kabla.
Ada ya usimamizi wa matangazo ni tofauti na unachomlipa Google kwa matangazo yenyewe.
Malipo yakichelewa zaidi ya siku 14 tunaweza kusimamisha huduma baada ya kukujulisha. Hatufuti chochote kwa siku 30 baada ya hapo.

5. Kumaliza makubaliano

Unaweza kumaliza wakati wowote, ikianza kufanya kazi mwishoni mwa mwezi uliolipiwa. Hakuna adhabu wala muda wa lazima.
Tunaweza kumaliza kwa taarifa ya siku 30.
Tunaweza kumaliza mara moja kama huduma inatumika kwa mambo kinyume cha sheria au yanayovunja sera za Google.
Ikiisha, akaunti yako ya Google Ads, historia ya kampeni na taarifa zako zinabaki zako. Sisi tunaondoa ruhusa yetu.

6. Uwajibikaji

Tunafanya kazi kwa umakini na tunarekebisha makosa yetu bila malipo. Pale tunapowajibika kwa hasara, uwajibikaji wetu wote hauzidi ada uliyotulipa katika miezi mitatu kabla ya tatizo.

Hatuwajibiki kwa yanayofanywa na Google, Cloudflare, Meta au mtoa huduma wako wa intaneti, wala kwa fedha unazotumia kwenye matangazo kupitia akaunti yako mwenyewe.

Hakuna kilichomo hapa kinachopunguza haki uliyonayo chini ya sheria za Tanzania ambayo haiwezi kupunguzwa kwa makubaliano.

7. Faragha

Jinsi tunavyoshughulikia taarifa binafsi imeelezwa kwenye Sera ya Faragha, ambayo ni sehemu ya masharti haya.

8. Mabadiliko na migogoro

Tukibadilisha masharti haya tunabadilisha tarehe juu na kuwaeleza wateja waliopo. Mabadiliko yanaanza kufanya kazi mwanzoni mwa mwezi wako unaofuata uliolipiwa.

Masharti haya yanatawaliwa na sheria za Tanzania. Kukiwa na tofauti, zungumza nasi kwanza — matatizo mengi yanatatuliwa kwa mazungumzo moja. Kama hiyo haitoshi, mahakama za Dar es Salaam zina mamlaka.
